1. Scope and provider

These General Terms and Conditions (GTC) apply to all orders placed via the online store at sesto-vision.com.

Deviating terms of the customer apply only if we have expressly agreed to them in writing. Upon completion of an order, these GTC are deemed to have been accepted.

2. Conclusion of the contract

The presentation of products in the online store does not constitute a legally binding offer, but a non-binding invitation to place an order.

By completing the ordering process, you submit a binding offer to purchase the goods in your cart. The purchase contract is concluded as soon as we confirm the order by email or ship the goods. An automatic confirmation of receipt does not yet constitute acceptance.

We reserve the right to refuse an order without giving reasons, in particular in the event of obvious pricing errors, suspected misuse or unavailable goods. In this case, we will refund any payments already made in full without delay.

3. Prices and value added tax

All prices are in Swiss francs (CHF) and are final prices including statutory value added tax.

Standard shipping within Switzerland is included in the price. For deliveries to the EU, the shipping costs stated in our shipping policy apply. Any customs duties and import charges for deliveries outside Switzerland are borne by the customer.

The price shown in the store at the time of the order applies.

4. Discounts and promotions

Unless otherwise stated, discount codes and automatic promotions cannot be combined with each other. We reserve the right to modify or end promotions at any time; orders already completed are not affected.

5. Payment

We accept Visa, Mastercard, American Express, TWINT, PayPal, Apple Pay, Google Pay, Shop Pay and Klarna. The payment methods available at checkout are shown there.

Payment is due upon completion of the order. Payment is processed by the respective payment service provider, whose terms apply in addition. We never receive complete credit card details.

6. Delivery

We deliver to Switzerland and to the countries of the European Union listed in the shipping policy. Shipping is carried out by Swiss Post.

Stated delivery times are guidelines and not guaranteed characteristics. Delays caused by customs clearance, public holidays or high shipping volumes do not give rise to any claim for damages or withdrawal, provided that delivery takes place within a reasonable period.

If an item is temporarily unavailable, we will inform you without delay and give you an expected delivery date. In this case, you may withdraw from the contract; we will refund any payments already made in full.

7. Retention of title

The goods delivered remain our property until paid in full.

8. Voluntary right of return (30 days)

In addition to statutory claims, we grant a voluntary right of return of 30 days from receipt of the goods. The goods must be returned unworn, unused, complete, in their original condition and in their original packaging. Proof of purchase is required.

Returns must be registered in advance at hello@sesto-vision.com. We cannot process unregistered returns. Details are set out in our return policy.

9. Right of withdrawal for consumers from the EU

If you order as a consumer residing in the European Union, you additionally have the statutory right of withdrawal of 14 days from receipt of the goods. You can declare your withdrawal informally and without giving reasons by email to hello@sesto-vision.com.

In the event of a valid withdrawal, we will refund all payments received, including the cost of the cheapest standard delivery offered by us, without delay and no later than within 14 days. The direct costs of returning the goods are borne by the customer. Our voluntary 30-day right of return remains unaffected.

10. Warranty and notification of defects

The statutory warranty provisions of the Swiss Code of Obligations apply (Art. 197 et seq. CO). The warranty period for new goods is two years from delivery (Art. 210 CO).

Please inspect the goods immediately upon receipt. Obvious defects must be reported to us within seven days of receipt, and hidden defects immediately after their discovery, at hello@sesto-vision.com — with the order number and meaningful photos.

In the case of a justified defect, we will, at our discretion, provide a replacement or refund the purchase price. Excluded from the warranty are normal signs of wear, damage caused by improper handling, dropping, contact with chemicals, and alterations by third parties.

11. Liability

We are liable without limitation for damage caused intentionally or through gross negligence. In the case of slight negligence, liability is limited to the foreseeable damage typical for the contract.

Liability for indirect damage, consequential damage and loss of profit is excluded to the extent permitted by law. Liability for personal injury and under the Product Liability Act remains reserved in all cases.

Our sunglasses offer the UV and glare protection stated on the respective product page. They are not suitable as protective eyewear within the meaning of personal protective equipment, for looking directly at the sun, or as a visual aid.

12. Data protection

The handling of your personal data is governed by our privacy policy, which forms part of these GTC.

13. Applicable law and place of jurisdiction

All orders are governed exclusively by Swiss law. The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.

14. Final provisions

Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that comes closest to its economic purpose.

We reserve the right to amend these GTC at any time. The version in force at the time of the order applies.
